Please read this message, members. There may be instances where the surveyor is blamed and it's actually the condition of the boat.

The Insurance companies and financial institutions are getting too much exposure with all the boats being sold. I have seen this many times over my 23 years as a Insurance agent. The last several surveys we performed, the insurance companies would not insure , or bind allowing the new buyer time to make repairs. The only way appears to be the owner has to do it. Any thing like a frozen sea valve, bilge pumps, fuel system corrosion, exhaust system will be turned down it appears. This is common when this happens along with rate increases. May only be California. they also will not insure with out experience and a safety course. to many boats being sold here to total newbies that has caused more risk for them.

Members: When you renew, you will have the option of asking for a standard letter of certification to attach to your reports. Look at your renewal at the bottom or mention when you call with your renewal. The spike in boat sales has allowed for a huge spike the need for surveys. If anyone says that you must be SAMS or NAMS they are breaking labor laws. Simply attach the cortication letter or provide to your client. You must stand your ground. We sponsor online events and our name is now everywhere. When you are questioned it is usually by a broker or agent who is ignorant. Refer them directly to headquarters or provide me with the name, phone number or email. Also use the co-equivalency AIMU memorandum. I am very proud of the work we do. Remember, we are where your journey begins.

Our sails and rigging course is a big success. (I try to avoid using the word "huge" it's become a cliche.)

Please see this message: G'day Dr. Harper. I just finished the sail and rigging course and loved it. I have been rigging and inspecting rigging for a while now 12 years I believe and have some bits of information that may help someone just getting started. Know the differences between Sta-Lok/mechanical and swaged wire fittings and their weaknesses and strengths https://www.stalok.com/ & http://riggingonly.com/wire.htm#WIRE are good sources of information. Knowing the types of wire used in standing rigging and also their strengths and weaknesses is important to determine the "life span" and how to adjust the rigging https://theriggingco.com/2016/11/28/wire-rigging-vs-synthetic-rigging-vs-rod-rigging/ this site offers a nice description of three types of standing rigging. The company is also very friendly and glad to help and advise anyone in tuning their rig. I know its best practice to not recommend products, but I always climb without any person except me handling my climbing line and chair. I do have a deck helper to aid me, but I do not rely on them to "hoist" me up or "drop" me down. I have climbed for years using this self climbing chair and it is safe and great https://www.atninc.com/atn-mastclimber-sailing-equipment.shtml. During my inspections I carry a T-bevel gauge to properly check the spreader angle making sure they are set to the same degree topside to bottom side, and port to starboard. I also carry emery cloth to gently sand any oxidation and surface scratches from swaged ends on the wire. doing this will reveal any hairline cracks. On the way up the mast I use a gloved hand to check the wire for "meat hooks" or "fish hooks" that are individually broken wires in the strand while I check the coloration of the wires in the strand where they touch looking for brown stains indicating rust, because wire rope rusts from the inside out making it hard to see, until it's too late usually. Lastly, in a busy marina where there is a wake, or on a windy day, I wear a bicycle helmet to reduce the evential bang on the head. while the movement on deck may not seem much, 40 or 50 feet up the mast your swinging side to side much more.

I hope you can use any part of this information. I had a sail school, and occasionally will teach someone still and I had to chuckle because one of my handouts was one of the illustrations you sent with the course! I am enjoying NAVTECH and this new venture immensely! Thank you! Have a great day.

The purpose of this MSIB is to provide the Coast Guard’s current position on commercial vessel compliance activities during this national emergency for COVID-19.

Members, we are working on expanding our houseboat section as a result of the terrible fire in Alabama. Please send us any houseboat surveys you care to share or ny other resources that will help others. Houseboats make up less than 2 percent of recreational boats (approximately 12-15 million depending on whose statistics you believe.) However, they are the 3rd most deadly of boating accidents, particularly carbon monoxide poisoning--and now fires, after fishing vessel and collisions.

Subject: 2nd Annual Commercial Fishing Vessel surveyors meeting Thursday Nov 21st.

Annual 3rd Party Organization meeting - The Coast Guard is again organizing a meeting during the Pacific Marine Expo with all Class Societies and Marine Surveyor organizations that are authorized to conduct exams of commercial fishing industry vessels on the west coast and Alaska.

The meeting will be on Thursday Nov 21st from 1000 to 1100 and will be in the press briefing room 1D01 (the same room as last year), located on the north side of the expo floor.  We will have signage in place to guide you, or you can stop by the Coast Guard booth (501) for directions. The Expo opens at 1000 so please try to be there and in so we can start our meeting.

NTSB: CELL CHARGING A POSSIBLE IGNITION SOURCE IN DIVE BOAT FIRE

After an extensive dive search, the remains of 33 out of 34 missing individuals from the dive boat Conception have been recovered, and officials are using DNA analysis to determine the identities of the victims. An investigation into the cause of the deadly fire continues, and officials with the NTSB have conducted initial questioning for the five crewmembers who survived. While the circumstances of the blaze are not yet known, attention has turned to the possibility that a charging station for personal electronics in the berthing area may have been the source of ignition. One survivor believes that battery charging may have been the cause, according to the LA Times, and the NTSB said Thursday that it would be examining this scenario. “We are not ruling out any possible ignition sources,” NTSB board member Jennifer Homendy said Thursday at a press conference. “[There] may have been a lot of cameras and cell phones that were charging on this vessel.”

Dive trip organizer Ken Kurtis, the owner of California charterer Reef Seekers Dive Company, told Fox News that the charging station could have potentially been an ignition source. "We know that divers were carrying cameras and stuff like that that have rechargeable batteries. [Was] there an issue with some of these chargers? It could be something as simple as a small camera battery being charged overnight while everybody's asleep, has a short, and that's what starts the fire," said Kurtis. He added that he had never heard of a serious fire incident aboard any California dive boat before, and that it was a risk that the community of California divers had not thought much about previously.

The Conception was a fiberglass-built passenger vessel constructed in 1981. The U.S. Coast Guard classifies fiberglass laminate (fiber reinforced plastic) as a combustible material, and in previous deadly fires, fiberglass-hulled passenger vessels have demonstrated the potential to burn to the waterline. Recent Coast Guard inspections had determined that Conception was fully compliant with all applicable regulations, including applicable fire protection requirements. Those rules do not require vessels of her size to be built from noncombustible structural materials, as federal and international law requires for large passenger vessels. Members, we know many of you are anxious to help after Florence and Michael. The steps are fairly simple.

  1. You must be there and willing to travel if not. Surveyors and adjustors who get the work let the insurance companies know they are already on scene.
  2. Communications are often non existent or slowly coming back online.
  3. Power sometimes isn't back for weeks or months.
  4. Every insurance company has claims adjustors in place BEFORE disasters.
  5. You should be working all year ahead of time. Many require going to their adjusting schools to work for them. For instance USAA has adjustors schools, not necessarly for just boats but for all property. Preference is given to state licensed claims adjustors.
  6. Have a resume ready. Updated and highlights maritime experience.

​​A recap of the 2018 annual American Boating Congress May 9-11, 2018 in Washington, DC

Dear Members:

Last Wednesday through Friday, Navtech was pleased to represent our esteemed membership again, as we have done in the last two spring ABC conferences, at the annual 2018 session of The American Boating Congress (ABC), planned and hosted by the National Marine Manufacturers Association

The last day of the conference was Friday, May 11. It entailed guest speakers, including Rear Admiral Tim Gallaudet, Assistant Secretary of Commerce for Oceans and Atmosphere and Acting Undersecretary of Commerce for Oceans and Atmosphere at NOAA. Admiral Gallaudet discussed ways public-private-partnerships (P3) between the federal government and private companies / boaters work together to increase technological capabilities for better weather predictions on the water. Further, the admiral discussed the post-hurricane impact of "ghost fishing" in the Florida Keys that has deleterious impacts on marine life including economic waste in the fishing economies and disruptions for underwater ecosystems, and most importantly, inhumane consequences with unnecessarily trapped marine life in abandoned lobster traps. As such, private entities are teaming with the government to map and locate abandoned lobster traps and remove them. 

The ABC's last day also had a featured speaker, Chris Wallace, from FOX News Sunday, who offered a lively reprieve on the big picture. Chris Wallace discussed North Korea, issues with the Trump Administration culture including the tenuous relationship with the media, and offered observations on the changing global landscape with what he considered to be most historically pivotal president in America's history.

The ABC conference was full of lively discussions and an all-day trek to Capitol Hill on Thursday May 10, where ABC attendees got to meet with members of congress to address key issues affecting boating and fishing. Note a few pieces of legislations we'd like to share with you and that is of particular timing importance with substantive, down stream economic impacts on the boating industry in the United States. 

  1. The Modern Fish Act: (H.R. 2023 and S. 1520) introduced April 6, 2017 by Congressmen Gene Green of Texas and Messrs Witterman and Webster of Florida : this bill is to amend parts of the Magnuson-Stevens Fishery Conservation and Management Act, codified as 16 USC § 1801 and addresses recreational boating exemptions for privileged permits to fish, requires that the National Academy of Sciences works with both the South Atlantic Fishery Council and the Gulf of Mexico Fishery Council on obtaining more data and implementing a better program on sustainable fishing and fish populations.
  2. Better EPA Labels for E15 Fuel: NMMA is encouraging the EPA to continue its improvements to the former EPA improvements to the label of E15 ethanol fuel, which would include an increased font size of the word "Warning" in lieu of "Attention" on the label and offer other safeguards through the EPA's oversight of the label.
  3. Designation of National Fishing and Boating Week June 2-10, 2018House Resolution 871 to express support for the designation of the days of June 2 through June 10, 2018 as National Fishing and Boating Week. 
  4. Tariff Letter on 232-Tariff on Aluminum Sheet: And lastly but very importantly, ABC shared a copy of the letter from Congressmen Bill Posey and Collin Peterson addressed to both Wilbur Ross, the Secretary of the U.S. Dept. of Commerce and to Rhonda Schmidtlein, Chairman of the U.S International Trade Commission urging them to closely consult with the marine manufacturing industry stakeholders on the issue of aluminum sheet production and the potential for economic chilling effects to boating manufacturing. The letter states it was "troubling no one from the (Department of Commerce) met with any of the marine manufacturers that use this sheet aluminum material prior to self-initiating this action." The marine manufacturers use aluminum sheets for manufacturing boats, especially pontoons, fishing boats, fuel tanks, boat lifts, boat trailers, and other parts. The letter points out that it is already difficult to source 72" sheets and this tariff will further compound the sourcing of raw materials. The letter points to a further study by direct contact with the industry to fully grasp the pending antidumping duty (AD), countervailing duty (CVD), and 232-aluminum tariff proposals and its real economic concerns to the American boating industry, including retaliatory risks against U.S. boat imports by countries impacted by the restrictions on outsourcing raw materials for boat making. The letter cites to 2016 statistics and states that the recreational marine industry comprises 95% of boats in the U.S., employs approximately 650,000 Americans and 35,000 businesses, and contributed both $121.5B to the national economic activity and $38.2B to the U.S. gross domestic product. The letter says, "consequences of a worldwide tariff plus steep AD/CVD on the U.S. marine manufacturing industry will be deleterious with the potential loss of thousands of U.S. jobs." The states mentioned especially effected from the pending tariff and other regulations tightening outsourcing include Washington state, Florida, Arkansas, Indiana, Michigan, Minnesota, and Missouri. I will be posting the final complaint sometime this week for all to see. This is a time consuming process, so don't expect immediate answers. Those of you who said yes to being deposed, witnesses or filing an affidavit, please stand by (per my earlier missive last summer). Rob Scanlon sent us this alert: Marine financing lenders and bankers now want the hull (HIN) numbers in all digitals in all survey reports clear and legible. I use multi-colored chalk -- white or yellow hulls/black chalk; red, green, blue, black hulls white chalk. Using chalk back and forth over the HIN numbers and a quick wipe with a rag makes the HIN numbers stand-out clean and clear in the digital photos.

I would caution that in this current business climate there are those would use your report for unintended purposes. Many customers don't understand that a buyer or seller can't "sell" a survey. You might consider adding a phrase or two such as "this survey belongs the person who authorized the survey and is intended for that client only. No future warranty either by sale or purchase is implied or transferred by surveyor."

Many surveyors will misrepresent themselves as being associated with, affiliated with or part of US Surveyors.  We have been around for such a long time that many surveyors have taken our courses and forget that they must renew to stay active in US Surveyors.  Students may always advertise the fact they they have gone through our courses by using our Navtech name.  But it is clearly stated in our courses that members must renew annually to stay active.  So, if you are a former student or member and you would like this organization to continue to confirm your references and your affiliation as an active surveyor, please renew.  Please do not place headquarters in an unethical and possibly litigious position..

In the interest of transparency. This attorney is my son, Florida attorney, Robert B.H. Phaneuf, who will take our case pro bono.

You've definitely helped surveyors earn a living but through your surveyors you have prevented all kinds of boating disasters.

Along these same lines making qualified surveyors available, you have helped boaters get insurance and also commercial fishermen get licenses, etc. For example, as a lawyer I deal with a certain amount of issues with respect to the California Department of Fish and Wildlife and having a back ground as a Surveyor is really a plus. Along these same lines, my family has been involved in the fishing industry since before Columbus and we have two boats at this time. Your program has helped me be a safer boat owner/operator as well...and this is after I already had 35 years of experience as well as my 100 ton captain's license before joining your program.

If you would like to put me down as giving a free phone consultation to members, I'd be glad to do it. As a general comment, a little legal advice early on can frequently avoid problems later. In any event, thanks again and enjoy the summer.

About six weeks ago, I purchased the 2M Master Marine Pro computer and software to diagnose all marine diesel engines. ($16,475.00).
 
This system was developed in Madrid Spain.  Clement, one of the designers of this system spent last week with me doing marine diesel engine surveys here in New England.
 
There is only one other marine technician here in the United States with this system and he is located on the west coast.
 
Me fee for diagnosing a marine diesel engine is as follows:
 
(4) cylinder @ $375.00
(6) cylinder @ $650.00
(8) cylinder @ $950.00
(12-16) cylinder @ $1500.00
All larger engines are negotiated.
 
I just updated my CDI/MEDS (Marine Engine Diagnostic Systems) last week. This system diagnoses every gasoline inboard engine; all make model outboards from 2017 back to 2000.
 
Fee structure range from $295.00- $425.00.
 
I eblasted every yacht broker and dealership from Maine to New Jersey with respect to my ability to diagnose marine engines. I was bombed with calls.
 
If any of our USSA members wanted a full diagnostics & compression testing on all make model engines, I will be a call away.

Good Morning Aaron:

As long time advertisers in two of your publications, we are extremely dismayed by the article about marine surveyors, written by Mike Telleria, which appears in this month's issue (Parting Shot) of Professional Boatbuilder. This article has also been brought to our attention by some of our members.

After reading the article, I am alarmed by the lack of information and integrity purveyed by the author, and by the obvious attempt to support and recommend only two surveyor organizations. As a publisher, it appears that Professional Boatbuilder implicitly supports this attempt at Restriction of Trade. As,over the years, which I can document, we have trained most of the current members of both organizations, we find this article extremely biased and borderlines on the promotion of Restriction of Trade. I cannot help but wonder why you would publish such a slanted article that advertises our competitors over and over, without me having been contacted or interviewed by Mr.Telleria. We are where surveyors begin their professional journey. Surveyors are indeed held to a higher standard. There are no such things as "diploma mills" in this business and I know of none.

Navtech USSA has been around and professionally training marine surveyors for almost 30 years. We know a lot about the business and we know the truth, objectively. That Mr. Telleria would write such an article that clearly promotes certain organizations over others, lacks journalistic integrity and that your magazine would publish without fact checking, especially with us, one of your long time advertisers, has me question your journalistic integrity as well.

I would like the chance to write and have you publish a "parting shot" rebuttal to Mr.Telleria's errant article.This article will explain clearly the process of becoming a marine surveyor, something which Mr. Telleria has done by drive by uninformed journalism. I have informed our members of this article. I am certain you will be hearing from them as well.

The Coast Guard published a solicitation notice in the Federal Register on Wednesday February 10, 2016 (81 FR 7133) seeking applications from qualified candidates seeking consideration for appointment as public members to the Towing Safety Advisory Committee (TSAC). TSAC advises the Coast Guard on matters relating to shallow-draft inland and coastal waterway navigation and towing safety. 

There are six TSAC seats that will become vacant on September 30, 2016:

* Three representatives from the Barge and Towing industry.
* One representative from port districts, port authorities or terminal operators.
* One person representing licensed or unlicensed towing engineers with formal training and experience.
* One person representing shippers.

Mr. Miklus:

Thank you for the reminder.   Again, while I have enjoyed my affiliation with AIMU, East Coast Marine Surveyors, LLC will remain an internationally and domestically accredited member of USSA (well Established since 1987)and The International Institute of Marine Surveying IIMS (in London), two private societies dedicated to highest standards of care, ethics and professionalism.  Our company will remain autonomous in what defines our "Qualifications," as every surveyor should.  We will not seek approval, validation or intention to "ride the coat tails" of any particular private society.  We offer unbiased, qualified and independent services free from conflict of interest or prejudice.  

Seeing AIMU's decision will not support links to well established private societies a number of previously listed surveyors belong, perhaps the organization might consider a caveat within their "Find a Surveyor" feature explaining Private Societal "Affiliations" do not define OR guarantee a surveyor's qualifications.  Regardless of what you hear, are told, or what propaganda a particular someone or particular committee has marketed you, the fact is all "reputable" surveyors of any private organization look at the same books, practice the same ABYC, USCG and NFPA standards, make judicious observations with detailed notes and issue unbiased reports with reasonable content free from conflict of interest or prejudice.  There is nothing mystical or coveted about what constitutes a "good" or complete marine survey report.  However, what defines a "good" marine surveyor has to do with: moral character, applicable marine experience, technical compliance, work ethic and standard of care as opposed to paid private societal memberships.  All Independent Marine Surveyors must maintain autonomy insofar as what defines their operations as "qualified."  A bank, an insurance company or anyone suggesting or forcing someone to use a surveyor who is a member of a particular private society reeks conflict of interest (something every credentialed marine surveyor has pledged to avoid).  In most states it is illegal, classified as a restriction in trade, interference with business or blackballing.

As you do know, many private organizations (World Wide) assist independent marine surveyors. Two larger societies overseas are the International Institute of Marine Surveying (IIMS) and the Australasian Institute of Marine Surveyors (AIMS).  There is also The Association of Indonesian Marine Surveyors in Indonesia (AIMI), as well as The Association of Marine Surveyors in British Columbia (AMSBC) Canada, Society of Consulting Marine Engineers & Ship Surveyors (SCMS) London, Swedish Independent Marine Surveyors Association (SIMSA) and More...

Domestically of course,  we have:  The United States Surveyors Association (USSA, Est 1987), American Registry of Marine Surveyors (A.R.M.S, Est. 2008), Association of Certified Marine Surveyors (ACMS, Est. 1990s), Society of Accredited Marine Surveyors (SAMS, Est 1986), and National Association of Marine Surveyors (NAMS, Est. 1962).

I hope the AIMU will consider the more accurate and broader perspective of the Global Marine Surveying Trade and the exclusionary nature that is seemingly being forced upon it by certain private societies that may think they are "the best," the "only," or have a "monopoly."

Description: This 5-day course is designed to provide Examiners with a comprehensive understanding of the current federal regulations and CG policies applicable to the uninspected towing vessel industry. I have created a Private Vessel Check List for use with Non Commercial vessels. This will save you a lot of paper, ink, and time if you're inspecting a private yacht. While we felt that the combination or generic approach was best, it was wasteful if you are not doing a commercial boat. Since the present check list is for both commercial and private that will remain the same. I suggest you retitle that one as commercial only.

For those of us who wear uniforms or shirts with our company name I thought a patch bearing the USSA Logo would be a positive touch. At this time are there any plans to offer a patch? FYI--Trivia

It turns out that much of the power of the federal government to attach / arrest PROPERTY (not people) - comes from constitutional law and admiralty.

In other words -- to give a background history of admiralty law in 30 seconds or less, it is entrenched in the thinking of our Founding Fathers because at the time of the drafting of the Constitution, the Framers were very aware of the special needs in transportation and how the laws governing the sea would need to be different than those governing land, so some of the oldest "speciality" law involves admiralty, where special courts would sit to decide how to divide the spoils of privateering and how to save courts of remedy to suitors seeking relief from nautical ventures. Consequently, specialty methods for SEIZING property AKA "arresting ships" were permitted without violating the constitutional protections of personal property. This was an exception to the general rule that "the government can't take your property." It turns out that they can, and they did it to a Drug Lord's Mansion.

It is not often invoked, but it is a constitutional backdoor channel that is sometimes used. Most famously - one of Pablo Escobar's henchmen, Indalecio Iglesias, was trafficking money and drugs in Miami. The feds were unable to do anything about it, so they actually used ADMIRALTY law to SEIZE his HOUSE. This was unprecedented, but it was the only way they could find to constitutionally take his property.

After reviewing some 3rd party examination checklist and reports, I realize that important information is not captured during the CFVS exams. In some forms, items are listed but the examiners forget to capture them in detail. Coast Guard uses this information during a casualty response operation or dealing with safety security operation and it is very important that we update the information during a CFVS examination. Please make sure that the information listed in the attached form is captured and forwarded to USCG for documenting in MISLE (CG data base). You may incorporate the information into another form or use this as a supplement and fill out the form in its entirety. Please call me if you have any questions or concerns.

Who Needs Maritime Insurance? by Virginia Harper Ed.D.

Who needs maritime insurance? If you are a marine surveyor, you should have at the very least marine liability.
A: Anyone that works on or near the water, or whose employees work on or near the water needs maritime insurance. This includes: Yes you got it…marine surveyors. There are three primary insurances a marine survyeor should consider especially if you are working in or around a boatyard/marina and even if you visit a dockside home. These are:

longshoreman’s insurance
workman’s compensation
marine liability for commercial marine contractors–that’s you.
Don’t panic, you may not need all but you should at least check with your state requirements.

There are more depending on your state requirements. Most marinas require marina liability before you can work in their yards and some require workman’s comp combined with longshoreman’s (that’s a form of dock coverage). Others are below.

Can My Insurer Require Yacht Surveyor’s ‘Recommended’ Repairs?

Q: I recently hauled out my boat at a local yard for routine maintenance. While it was out of the water, I had the boat surveyed ― pursuant to a request by my insurance company.

We are now ready to launch the boat, but the insurance company wants us to complete all of the surveyor’s recommendations as a condition for their renewal of the policy. We’re a little annoyed at this, since a lot of the recommendations seem to be along the line of cosmetic issues rather than problems that will affect the safety or seaworthiness of the boat. We called around to a few other insurance brokers, but they all require this work to be completed. Is there any way to get around this requirement? What risks do we face if we don’t complete all the recommendations?

A: Marine insurance companies evaluate the risk of a particular yacht policy based on a lot of factors, and the physical c ondition of the boat is, of course, an important consideration. The survey report is usually their only tool for evaluating the condition of the boat, and they invariably require the items listed on the report as “recommendations” to be addressed as a condition for issuing or renewing the policy.

Many yacht owners are inclined to take care of the “important” items on the surveyor’s list of recommendations, while overlooking some of the items that they perceive to be less important. They may believe that these lesser projects are “cosmetic” in nature, and that the insurance company will be unlikely to learn of the oversight. However, the signed statement required by most insurance companies to confirm the completion of survey recommendations must be executed by the yacht owner in good faith, and a misrepresentation will probably lead to the denial of an insurance claim.

Marine insurance policies are generally controlled by the doctrine of “uberrimae fidei,” requiring the parties to the policy to deal in “utmost good faith.” Simply put, this doctrine requires the yacht owner to disclose any information that may be related in any way to the coverage that is being considered, and to deal with the insurance company in good faith in all aspects of that relationship.

Failure to do so may lead to their denial of an insurance claim, even if the oversight had nothing whatsoever to do with the loss.

Most insurance companies will require the deficiencies noted as “recommendations” in a survey report to be corrected, and a misrepresentation or inaccuracy in that communication will be deemed a violation of the insured’s obligation to deal with the insurance company in “utmost good faith.”

If a yacht owner wants to be relieved of the obligation to correct all of the recommendations on a report, his or her first course of action should be to discuss the report with the surveyor. This is actually a good idea, regardless of the insurance issues.

A marine surveyor is an expert in evaluating the condition of a boat, and the survey report provides valuable information to the boat owner that may not otherwise come to light. Most survey reports include a narrative discussion and a set of “notes,” in addition to the more serious “recommendations.” Insurance underwriters do not typically require any action to be taken for items that appear in the discussion or “notes” section of the report. A boat owner may, therefore, have an opportunity while discussing the report with the surveyor to move certain questionable items from the “recommendations” section to one of the less critical sections of the report.

If the surveyor is reluctant to reclassify any of his findings, there may, nonetheless, be some amount of flexibility in dealing with the insurance company. But the key ― in all of this ― is communication. The insurance company may agree that the replacement of a cosmetic feature of the yacht’s interior is not necessary, but the yacht owner may void the insurance coverage if he or she reaches that conclusion without the insurance company’s cooperation.

The denial of a marine insurance claim may be based on various factors ― but, regardless of the basis for denial, it may subject a yacht owner to a catastrophic loss of thousands of dollars. The completion or negotiation of a list of survey recommendations is a comparatively simple process that will help to keep your coverage intact.

Subject: EXTENSIONS FOR PERCUSSION-SOUNDING HAMMERS
About a year ago, I made these extension handles for my percussion sounding hammers to reach those hard-to-get-at areas under engines and along the lower keel and bottom areas of yachts stored out of water on keel blocks & jackstands. The extension handles are from a pair of old oak crutches I found in my neighbor's garage. These work great and I thought I would pass this along to out members.

Navtech USSA has been around the boating business now for almost 25 years. When we started, distance training, while a vital part of the education industry, was regarded somewhat skeptically, especially in the hands on profession of marine surveying. However, time has proven us to be future predictors, groundbreakers and forerunners of simple, efficient training and certification. Thank you for support over the years. In answer to one of the most asked questions we receive, please read our certification summary: Certification programs should always have a terminal examination. Certification should be based upon pre requisites or standards based learning. Standards such as USCG and DOT regs dictate marine surveyor training. Certification programs should interface material covered in the exam with necessary components of conducting the business. Certification such as our school is both broad based and complimentary to vendor based (Navtech--education/school) and non-proprietary certification (USSA-trde association). Diplomas from courses are not generally the same as certificates of membership.

News from the Northwest Syndicate!

Greetings All! It's good to be back in the Northwest and out of the heat down south. After some interesting experiences this winter in Puerto Vallarta, it's good to be back in the Emerald World and near my Harley. Clayton, Dave O and I will be burning up some roadways soon, I am sure. Steve and I have been developing the HHO systems (mostly Steve) cause it's all magic to me and he is younger, stronger but not as good looking as I, and we have a winning systems that is viable in the vehicle and marine industry. More to follow on that soon. After a great couple of trips, myself and other members of our team delivered Lionesse, a wonderful Cheoy Lee Motor Yacht, owned by Kate and Jim Bondoux, to Seattle from Mexico. It was a great way to kick off the summer. Kim MacDonald is no longer with us, down south, and will be missed. Dave O and his lady are back up North and she is getting over some knee issues. Clayton is here with me in the Sound area and is looking for something to keep him busy, so let's help his lady out and get him out of the house. Jesse is down there in Texas and has his sport fishing vessel up for sale. It's a real beauty, and he is motivated. Colin up in Vancouver is near the end of his USSA training and will be representing us in that area. He's a great asset. More on Allan below, he's been a busy lad for sure. 

We are pleased to announce that we are adding three new members to our team. These folks all come to us with great backgrounds and will be real assets to our already winning group. George Redman has a great varied background in the marine industry, is a fellow pilot, and lives up here in the Pacific Northwest where Clayton King, Dave Orchard and I (very part time) reside. He is starting his USSA training and will be taking care of the Bellingham and close by areas for us with surveys. Mark Percival will take care of the Portland Oregon area for us as a surveyor and also comes with a strong marine and inspection and valuation background. He is starting his USSA training and may be calling on you for ideas. Robert Kupps also fitted with a very strong marine background including delivery captain, instructor and charter operator, and owner will be representing us in Puerto Vallarta, Mexico where he lives full time. he too will be starting his USSA training shortly.

The industry is slowing getting back on its feet and some have been busier than others, but over all we are moving the right direction and with these new people we can stand tall and offer our service to a wider market base, which helps us all with Name Recognition.....It's a fun business we are in and it's an honor to stand with you all as professionals in a sometimes not so professional business. As a side note we are also talking to a great recruit in Alaska as well, hope to have him on board shortly.

Also be advised that Allan, after many years as my partner, supporter, co-founder of our company, and good friend has decided he and his lady want to go play for awhile on their new boat. He will be representing our company at large, and will always be one of our team, no matter where he is goofing off. As long as Wheeler Maritime is fighting the fight he will be a part of it. He has decided to sell his survey business in San Carlos, Mexico, so if you have any ideas for him, give him a shout.......His market is one of our stronger ones, and he has done a great job of building it up to where it is today.

I continue to collect information about individual agencies informing you that only SAMS and NAMS surveyors can be used. When you send me that information, I MUST have the complete contact and person's name you talked to including any correspondence in writing. Subject: Followup on UTV Surveys review and assessment

Good Evening Virginia,

Previously, I performed a Uninspected Towing Vessels (UTV) Examiner Program Review to determine if there were any real impediments to the USCG establishing a similar program like that of the Fishing Vessel Examiner Program for the Uninspected Towing Vessel Examiner Program currently restricted to USCG and USCG Auxiliary.

I looked at the existing Uninspected Towing Vessel Examiner vetting program that the USCG is using to vet active and reserve USCG as well as Auxiliary personnel as UTV Examiners. I have concluded from my assessment that there are no real deficiencies in training that exist for "third-party" examiners holding marine survey credentials except the NIMS requirements as highlighted below.

While this training is not really essential for the examiner program from a technical perspective, I does provide an exclusionary barrier to those who do not acquire the training. Commercial Surveyors should be exempt from this training since it only really applies to those individuals functionally part of the Department of Homeland Security for non-survey related response activities. This additional training includes:

  1. Incident Command System (ICS) 100 or Independent Study Course (IS) 100, Introduction to the Incident Command System (ICS)
  2. ICS 200, or IS 200, ICS for Single Resources
  3. ICS 300, ICS for Expanding Incidents 
  4. IS 700, National Incident Management System (NIMS), an Introduction
  5. IS 800, National Response Framework, an Introduction

For those surveyors that are interested, these courses can be acquired through on-line training at FEMA's Emergency Management Institute/National Emergency Training Center in Emmittsburg, MD with the exception of ICS 210 or ICS 300 which are residential-only courses. I'm on the faculty at the EMT/NETC and teach each of these courses, including ICS 300. If you're interested, My son and I can present a 5-day course that covers each of these elements resulting in certification of completion of a FEMA-approved NIMS curriculum program. Otherwise, it will probably take those interested approximately 3-4 months to complete the courses individually.

Additional requirements include a favorable Personnel Security Inquiry which can easily be addressed throughout the acquisition of a TWIC card.

Commercially credentialed surveyors are preeminently qualified to conduct these types of surveys because that what they do, even over the USCG (vice members of the MIO), USCGR, or USCG Aux. It cannot be assumed that a USCG Reservist or Auxiliary member has the necessary professional training, experience, or expertise (without professional surveyor training and credentialing or marine engineering degrees) to carry out these types of surveys in a professional and complete manner. The best they can hope for is some sort of "cookbook" approach with a self-explanatory checklist that makes a better but not solid survey.

I hope this helps in your endeavors to get the USCG to approve marine surveyors to conduct UTV surveys similar to the Fishing Vessel Survey program. Feel free to contact me for further support.

At present, this program is not available to you or us, unless you are a member of the CG Auxiliary and have the appropriate background.  If you are USCG AUX, then you can contact Patrick Lee at USCG headquarters 202 372-1135 on how to get in the first training cohorts if you don't want to wait for us--maybe yes, maybe no at this point. Hello Virginia, have a few minute breather, thought I would drop a line, did you receive the letter to the client from Boat US outlining, their requirements, and a couple of my surveys, that went to them. I have not had a problem with them at all, What I will say is in my experience is this, especially if you are a newer surveyor. Boat US can not turn down our surveys simply because we are not SAMS, or NAMS, however they can turn it down due to poor writing, not quoting ABYC, NFPA etc. just as you have stated in our manuals. For me I gave them no reason to scrutinize my reports by quoting almost every item per ABYC, strong Coast Guard Safety requirements , a long list of deficiencies, and last but not least included my Boat US membership on my up dated resume, that you stated they would ask for. I have joined and list ABYC, NFPA, US Surveyors, on every survey, and now include a business lic. #

The reason I am mentioning this is due to a survey turned down by one of our members, I read about on our members only site, Boat US really has ties with Nams, that is why I sent you a copy of a Nams survey I had. I noticed in that survey they only cited ABYC maybe twice if I can remember, funny how that works, anyway it is what it is, and all these guys have to do is follow your instructions, attach, a resume, Quote ABYC, NFPA, Coast Guard, be neat and tidy. Sorry you already know what I have just said, wish there was a way to help more, their letter was pretty straight forward with their requirement.

Rob Scanlon provided me with insurance options for my client who successfully found an underwriter at a significant savings over Boat US, Please pass on to all USSA members to ask their client before scheduling the survey "WHO their carrier is and HAVE they reviewed the Boat US Survey Scope? 

Welcome! This directory is designed to help you find a professional marine surveyor in your area. Please note that BoatUS does not endorse or guarantee the performance of surveyors. No warranties expressed or implied are intended or created by this directory. Any questions regarding the scope of a surveyor's inspection, their cost or the content of the reports should be discussed with the surveyor.

Here's how to get the most useful survey for your money: 
Be sure to let the surveyor know the purpose for which you are requesting the survey. If the reason is for the purchase of a boat, or to fulfill an insurance requirement, ask for a full condition and value (C&V) survey. This type of report will typically estimate the current market value for the boat today, the value to rebuild the boat in today dollars in addition to a detailed description of the construction and condition of the hull and major systems (i.e. electrical, fuel, machinery, rigging, etc.). 

Make certain it is clear from the report that the surveyor has inspected the boat for compliance with the current boating safety standards set by the National Fire Protection Association (N.F.P.A.) and the American Boat and Yacht Council (A.B.Y.C.), as well as U.S. Coast Guard standards. 

Some surveyors offer abbreviated one or two page opinions, which they'll often refer to as an insurance inspection. This type of brief format will usually be rejected for insurance underwriting purposes since it omits details on the condition of the boat and its systems that are necessary for risk analysis. 

It is always appropriate to ask the surveyor for a copy of a resume, as well as a sample survey of the type that you are requesting. 

If you are selecting a surveyor in order to obtain insurance through the BoatUS program, please note the following: 
Generally surveys completed by persons directly associated with boat yards, marinas or brokers will not be accepted for insurance due to the potential for a conflict of interest. 

In most cases surveys done by insurance company personnel will not be accepted due to their brevity and lack of detail. 

Hauling is generally required on wooden, steel, or aluminum boats; boats which have sustained damage; and older hulls (request a quotation for details on your particular situation). The National Association of Marine Surveyors (NAMS) and the Society of Accredited Marine Surveyors (SAMS) are professional organizations that have instituted rigorous examination programs for their membership. BoatUS Marine Insurance underwriters will accept value surveys or pre-purchase surveys from those surveyors who have received the SAMS designation of "AMS" with a specialized classification of "Y-SC" (yacht and small craft) or NAMS designation of "CMS" with a specialized service code of "A" (yacht and small craft).

Summer long and hot. We hope you are having a productive summer season. Here are some questions from different members and here's how we answered:

Q. I see my survey is posted along with a boat for sale online at Ebay. The survey clearly says Private and Confidential, what would you do?
Answer: The survey, once completed and paid for, belongs to the client. Take the free advertising and go for it.

Q. I did a survey two months ago and now the owner claims he found a soft spot on deck. I didn't do a moisture meter reading because the boat was in the water at a marina. He didn't ask for one. Am I at fault?
A. Two months ago? The Disclaimer takes care of that. 

Q. BOATUS says they won't take my survey because I belong to the same yacht club as my client. I called BOATUS and they said that wasn't the reason they wanted more detail and cites to AB YC. It was my first survey for BOATUS. But it's ruined my reputation at the Yacht Club.
A. BOATUS is really really picky for reasons I have never been able to get a straight answer. Usually one call will do. The best result is to provide your client with insurance companies options.

Make sure you correct your client by calling him and telling him of your follow up and that the survey would have been accepted. Get the word out at the yacht club with fresh advertising and flyers.

Over last weekend I presented to a room full of safe boating experts at the National Safe Boating Conference in Daytona Beach. They were very interested in our profession. Attendees included marina owners, USCG officers, and even a few looking for surveyors. Navtech USSA is alive and well. A few of you should be hearing from some of those who needed surveys as well. This is a super conference. Next year, hope you can attend.

I am currently looking for assistance from someone who can provide expertise in the operation and command decision process with regards to operation of a commercial sailing vessel for tour purposes. The matter is in litigation, and may require providing expert witness testimony.

Such a vessel departed on a tour with over 50 passengers. They encountered a storm off-shore which resulted in the vessel sinking, and one passenger fatality.

I am the only USSA and only American marine surveyor, who is approved and works directly for a Notified Body, PRS (Polish Registrar of Shipping) to give the complete CE examination for boats going to Europe. Virginia, just a note to let you know that Zurich Insurance is canceling all of their yacht policies. They have decided to get out of that segment of the business. My phone has been ringing, and I am very busy with 40 to 50 ft Surveys, as the agents are finding new carriers, they all are requiring new Surveys. I suggest everyone visit a Insurance agency, that writes Zurich policies.

The Agents have been mostly the ones calling me, as they are embarrassed , and have to break the news to their clients, so they are getting all the ducks in place before the contact the effected people.
